Administration Moves To Incentivize Health Reimbursement Arrangements

The proposed rule includes a Department of Labor-only clarification to confirm that the definition of “group health plan” would not include premiums for individual health insurance coverage that are reimbursed by an HRA or other arrangement—so long as the employer complies with a variety of requirements. Individual coverage must, for instance, be completely voluntary for employees and the employer could not select or endorse the individual coverage.
